1. Introduction

Welcome to Bidsy, an online auction platform operated by Bidsy Pty Ltd (Registration Number: 2025/341227/07) with its registered address at 27 Manchester Road, Chiselhurst, East London, 5247, South Africa.

By accessing or using our website and participating in any auctions, you agree to be bound by the following Terms and Conditions. If you do not agree with any of these terms, please do not use this platform.

2. Eligibility to Use

You must be 18 years or older and a resident of South Africa to register and participate in auctions on Bidsy. By creating an account, you confirm that you meet this requirement.

3. Registration and Account Use

  • To participate in auctions, you must register an account using a valid email address.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to provide accurate and current information during registration and to keep your account details updated.
  • Bidsy reserves the right to suspend or terminate accounts that breach these Terms or are suspected of fraudulent activity.

4. Nature of Goods

  • All items listed on Bidsy are sold “as is” — no warranties, guarantees, or returns apply.
  • Items may include end-of-line stock, shop-soiled, or damaged goods.
  • Known flaws or defects will be described and/or shown in the product listing to the best of our knowledge.
  • There is no option for physical viewing. All items are listed and purchased online only.

5. Bidding and Payment

  • By placing a bid, you commit to purchasing the item if you are the winning bidder.
  • If you win an auction, you will have 3 (three) calendar days to complete payment.
  • Accepted payment methods include:
    • Paygate
    • Direct Bank Transfer (EFT)
  • Payment is considered complete once the funds have cleared into Bidsy’s bank account.
  • Failure to complete payment within 3 days will result in cancellation of the transaction and the item being relisted.

6. Delivery and Collection

  • Delivery is available as an optional add-on at checkout but is currently limited to East London main areas. We do not deliver beyond a 20km radius of our operating address. We do not deliver to outlying or rural areas.
  • Alternatively, customers may collect their items from our premises.
  • No item will be released for collection or delivery until payment has been fully cleared.
  • Customers have 5 (five) calendar days from the date of winning the auction to collect or arrange delivery.
  • Failure to collect or arrange delivery within 5 days will result in the cancellation of the order and a 5% cancellation fee, deducted from the total winning bid amount. The remaining amount will be refunded.

7. Pricing and Value

  • Indicative retail prices are displayed for reference only and are based on current market estimates.
  • These values are not binding appraisals and are provided to assist bidders in assessing the potential value of items.

8. Intellectual Property

All content on the Bidsy platform, including text, images, logos, product descriptions, and site design, is the property of Bidsy Pty Ltd and is protected under South African copyright and intellectual property laws. No content may be copied, reproduced, or reused without prior written consent from Bidsy.

9. Limitation of Liability

Bidsy Pty Ltd, its employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website, including but not limited to loss of profits, data, or goodwill.

All users acknowledge that items are sold without any warranty, and you agree to accept the risks associated with purchasing clearance/damaged goods.

10. Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of East London, South Africa, which is the company’s elected domicilium citandi et executandi.

11. Amendments

Bidsy reserves the right to update or amend these Terms & Conditions at any time without prior notice. Changes will become effective upon being posted to the website. Continued use of the site after changes constitutes acceptance of the updated terms.
